GENERAL ADMINISTRATIVE ORDER No. 2016-09 (AMENDED): SCHEDULING OF BAIL HEARING ON WARRANT (BODY ATTACHMENT) FOR NON-PAYMENT OF CHILD SUPPORT ISSUED BY ANOTHER JUDGE

IT IS HEREBY ORDERED that Cook County General Administrative Order No. 2016-09 (eff.
Nov. 22, 2016) is hereby amended as follows:
GENERAL ADMINISTRATIVE ORDER NO.: 2016-09 (amended)
SUBJECT: SCHEDULING OF BAIL HEARING ON WARRANT (BODY ATTACHMENT) FOR NON-PAYMENT OF CHILD SUPPORT ISSUED BY ANOTHER JUDGE
IT IS HEREBY ORDERED that, on weekends and court holidays, when an arrestee is in custody based only on the execution of a warrant or body attachment for non-payment of child support ("child support warrant"), or based on a new criminal charge prior to the initial bail hearing in the case, a violation of probation ("VOP"), or a violation of bail bond ("VOBB") and is served with or is already being held in custody on a child support warrant, the law enforcement agency with custody of the arrestee ("agency") shall promptly bring the arrestee before the appropriate court for a bail hearing. On regular business days, the agency shall first bring the arrestee to the court where a criminal charge, VOP, or VOBB is to be filed or is pending against the arrestee. On weekends and court holidays, the agency shall bring the arrestee with a new criminal charge, VOP, or VOBB to the Pretrial Division. When the arrestee appears before an appropriate judge of the court, including judges of the Pretrial Division, the judge presiding over the criminal matter shall also review the bail status of the arrestee's child support warrant. If the arrestee remains in custody on the child support warrant after the bail review decision and the child support warrant was issued by another judge, further judicial review of the bail set on the child support warrant shall be scheduled by the judge presiding at the instant appearance as follows:
1. Weekends and court holidays
a. If the warrant was issued by a judge who presides at the same courthouse facility, before the issuing judge no later than the next regular business day following the instant appearance
b. If the warrant was issued by a judge who presides at a different courthouse facility, before the issuing judge no later than the second regular business day following the instant appearance;
2. Regular business days. Regardless of the courthouse facility at which the issuing judge presides, before the issuing judge on the same day.
3. Every day, including regular business days, weekends, and court holidays
a. If the judge who issued the warrant is not available on the date provided in sections 1 or 2 above, the Presiding Judge of the Domestic Relations Division shall either review the bail on the warrant or designate a judge from that Division to do so on the date provided above.
b. If no judge from the Domestic Relations Division is available on the date provided in sections 1 or 2 above to review the bail on a warrant issued in Municipal Districts 2 through 6, the Presiding Judge of the District in which the warrant was issued shall review the bail on the date provided above.
IT IS FURTHER ORDERED that, for purposes of this order, a regular business day is any day
from Monday through Friday, except for court holidays.
